Opt-out: what it means

Choosing to stop receiving emails, usually by unsubscribing. The term also describes adding people by default and making them ask to be removed, which laws such as GDPR and the DPDP Act do not treat as valid consent.

Opting out means choosing to stop receiving emails, usually by clicking an unsubscribe link, using a mail app’s unsubscribe button, replying to ask, or updating preferences. Every marketing email should make this easy, and the request should take effect quickly and permanently for the kind of email the person left.

Laws set clear expectations. The US CAN-SPAM Act requires opt-outs to be honoured within 10 business days, and Canada’s CASL sets the same limit. Gmail and Yahoo expect bulk senders to process unsubscribes within two days. Under India’s DPDP Act and the GDPR, withdrawing consent must be as easy as giving it, and processing for that purpose must stop. In practice, there is no good reason not to stop immediately.

The term has a second meaning: an opt-out approach to collecting consent, where people are added by default and must take action to be removed, such as a pre-ticked box or an assumption that every customer wants newsletters. Consent-based laws like the DPDP Act, GDPR and CASL don’t accept this as valid consent. CAN-SPAM is the exception, being an opt-out law for commercial email.

Make leaving dignified. Don’t require a login, ask for a password or hide the link in tiny grey text. Offering choices such as fewer emails, a particular topic or a pause can keep people who are only tired of frequency. And if someone asks to unsubscribe by replying, process it; they shouldn’t have to find a link.

Example

A Bengaluru fitness app’s subscriber replies “please stop these emails” to a newsletter. The reply is caught by a rule that unsubscribes the sender automatically. She then receives one short confirmation and no further marketing.

In MailNesto

MailNesto applies unsubscribes immediately, supports one-click unsubscribe from mail apps, can unsubscribe people who reply asking to stop through reply-handling rules, and offers a Goodbye email recipe triggered by unsubscribing.

FAQ

Questions about Opt-out

How quickly must I process an unsubscribe?

CAN-SPAM and CASL allow up to 10 business days, and Gmail expects bulk senders to act within two days. Doing it immediately is best practice.

Can I send a confirmation after someone unsubscribes?

A single, non-promotional confirmation is generally accepted. Don’t use it to send offers or try to win them back repeatedly.

Can someone unsubscribe from marketing but still get receipts?

Yes. Unsubscribing from marketing doesn’t stop transactional messages, such as order confirmations, that relate to a service they are using.
